These Terms and Conditions are the terms and conditions of the subscription service agreement (‘Agreement’) between You and Nexus Enterprises Limited ( 12/F, Henley Building, 5 Queen’s Road Central, Central, Hong Kong ). Nexus Enterprises Limited (referred to as “Company, Provider, we, us, our, ourselves”) owns and operates the Sportify which offers you a variety of content that includes sport and sports news. he Service and all applicable content may contain copyrighted and/or proprietary subject matter. Your usage of the service and its applicable content are governed by these Terms and Conditions, all applicable laws, including but not limited to intellectual property laws. Your use of the service and its mobile content is under license.

The service costs Ooredoo prepaid users: 0.80 KWD/weekly postpaid users: 3.5 KWD/monthly / week as a daily subscription ( Ooredoo ) and 0.75KWD per week for Zain users. The 24 hours free trial is valid only for Zain new subscribers. It will be charged directly to your prepaid mobile phone or monthly bill until you unsubscribe from the service on the "My Account" section or by sending STOP 1 to 1415 for Ooredoo users and UNSUB SP to 93052 for Zain users or by sending an email to: info@sportify.me.

Please read the following Terms carefully, before using this service. By accessing and/or using this service, you will be deemed to have read, understood and accepted these Terms. In these terms, the following words and expressions shall have the following meanings:

„App Content” means all material, information, tools, content, hyperlinks, marks, and logos contained in or displayed on, and all apps and content which may be downloaded and/or accessed from or are made available through the sportify.me.

„Intellectual Property Rights” means trademarks, service marks, trade names, domain names, rights in designs, semiconductor topography rights, database rights of unfair extraction, utilization, and copyrights.

“Terms” means these Specific Terms and Conditions for sportify.me service as may be amended from time to time.

“Third Party Sites” means websites and/or mobile applications owned, operated or provided by third parties. The headings or titles to the clauses in these Terms are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these Terms.

Sportify is not responsible for “Losses” means all losses, liabilities, costs, damages (including damages arising from cyber-attacks), claims, expenses (including legal fees, costs and expenses on a full indemnity basis), compensation, demands, actions and proceedings, howsoever arising, whether in contract, tort (including negligence or breach of statutory duty) or otherwise, and whether direct, indirect or consequential.

This service offers you to unlimited access that includes sports news and all sport-related features on your mobile device through a content website. To access the service you must enter your mobile phone number and follow the directions established for this purpose. Your subscription for Sportify service will we automatically renewed for prepaid users: 0.80 KWD/weekly postpaid users: 3.5 KWD/monthly ( Ooredoo ) and 0.75KWD per week for Zain users. The 24 hours free trial is valid only for Zain new subscribers upon your account balance Errors are billed. Data charges apply for browsing & downloading contents on this portal. The user will be billed from the date subscription has been activated. By subscribing to sportify.me service you accept to receive renewal and content recommendation alert through SMS( Short Message Service). The user agrees to maintain the confidentiality of the account, and that it is fully responsible for all activities that occur under such an account. Whenever your subscription is valid, you can log on to your service an use it at any time and an unlimited amount.

Privacy policy

We create a mobile number database in order to keep the service functioning (your number is your username and is placed in the Sender id field to prevent sending anonymous messages). By using the Services you consent to us processing your User Data. If we have reason to believe that there has been or is likely to be a breach of security or any other misuse of the Services, we may suspend and/or terminate your subscription to the Services. We are not obliged to monitor, detect or report any unauthorized use of the Services and you shall be solely responsible for all use of the Services made by you or anyone else using your User Data, for preventing unauthorized use of your User Data and/or mobile device and you are liable for all user charges that are incurred as a result of any such unauthorized use.

Accessibility

This service is only available to users from Kuwait. The purpose of the service provided and operated by Nexus Enterprises Limited allows its Users to access and use content available at sportify.me website. This service can be used only from the mobile handset or device which meets or exceeds defined mobile platform operating system. By accepting this Terms and Conditions, the user agrees to maintain the confidentiality of the account, and that it is fully responsible for all activities that occur under such an account. While you’re subscribed to the service, you may use it at any time and on an unlimited amount. Nexus Enterprises Limited hall takes the necessary measures to ensure the protection and confidentiality of the personal information held by it.

Internet

If for any reason this Service is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Service Providers which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Service , the Service Providers reserve the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Service , at which time, Service Providers will conduct a random drawing from among all eligible entries received at the time of the Service termination. The Service Providers assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Service Provider is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Service Provider due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Service or downloading any materials in this Service.

SPONSORS ARE NOT RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. NOTE: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SERVICE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON/S RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Termination

You acknowledge and agree that in order to download, access and use the sportify.me content, you are required to at all times comply with the provisions of these Terms and satisfy the following, and you represent and warrant to Sportify service that you are of 18 years of age or above and are legally capable and permitted to accede to these Terms, you have in force a valid subscription for Sportify service provided by sportify.me, you are downloading, accessing and using this service on a mobile handset or device which meets or exceeds defined mobile platform operating system. User shall not sublicense the Licensed Material to another and User warrants that access will not be given to the Licensed Material to any person not being an authorized User. Any access to the licensed material given by Nexus Enterprises Limited must comply with the terms and conditions stated in this agreement. Any party to this Agreement may terminate this Agreement at any time, in no event will the termination of this agreement relieves the User’s obligation to pay any fees payable for the period prior to the effective date of termination.
